THE MEDALS OF FRENCH INDOCHINA

Le Gouverneur Général de l'Indo-Chine,

Vu le décret du 21 avril 1891 ;
Vu l'arrêté du Gouverneur de la Cochinchine, en date du 28 avril 1869, fixant la rémunération à accorder  aux  indigènes décorés et à ceux titulaires de médailles d'or et d'argent ;
Sur la proposition du Directeur des Affaires Civiles de l'Indo-Chine,
La Commission permanente du Conseil  Supérieur entendue,

      ARRÊTE :

Article premier. — La médaille d'honneur, décernée aux indigènes en Indo-Chine, constitue une distinction purement honorifique. Il peut ce pendant être attribué une gratification, une fois donnée, à ceux auxquels cette médaille est accordée pour acte de courage et de dévouement.

Art. 2. — A titre de mesure transitoire, les allocations prévues à l'article 2 de l'arrêté du 28 avril 1869 continueront à  être payées, aux indigènes titulaires de médailles d'honneur, qui bénéficient actuellement de ces allocations.

Art. 3. — Sont abrogées toutes les dispositions des arrêté antérieurs, contraires aux présentes dispositions.

Art. 5. — Le Directeur des Affaires Civiles de l'Indo-Chine et le Lieutenant-Gouverneur de la Cochinchine sont chargés, chacun en ce qui le concerne, de l'exécution du présent arrêté.

In view of the decree of April 21st, 1891;
In view of the order of the Governor of Cochinchina, of April 28th, 1869, fixing the remuneration to grant to those decorated natives and holders of medals in gold and silver;
On the proposal of the Director of Civil Affairs of Indochina,
On Consultation of the Permanent Commission of the Council Superior,

      ORDERS :

First article. — The Medal of Honor, awarded to native Indochinese, is a purely honorary distinction. The pendant can be granted as a bonus, once given, to those to whom the medal is awarded for Act of courage and devotion.

Article 2 — As a transitional measure, the allowances under section 2 of the Decree of 28 April 1869 continue to be paid to holders of native medals of honor, currently receiving these benefits.

Article 3 — All the provisions of earlier orders, contrary to these provisions are repealed.

Article 5 — The Director of Civil Affairs of indochina and the Lieutenant-Governer of Cochinchina is responsible, in so far as each is concerned, the execution of this order.

Vu les décrets du 20 octobre 1911, portant fixation des pouvoirs du Gouverneur général et organisation financière et administrative de l'Indochine ;
Vu le décret du 2 juillet 1935 ;
Vu l'arrêté du 28 avril 1869, fixant la rémunération à accorder aux indigènes décorés et ceux titulaires de Médailles d'or et d'argent;
Vu l'arrêté du 22 janvier 1902, déterminant le caractère purement honorifique de la Médaille d'honneur,

      ARRÊTE :

Article premier. — Il est institué en Indochine une Médaille d'Honneur destinée à récompenser les services  rendus par les particuliers, fonctionnaires et agents indigènes des Services publics de la Colonie, ainsi que les militaires indochinois

Art. 2. — La médaille d'Honneur comporte 4 degrés :

1° Médaille d'Honneur en or de 1re classe ;
2° Médaille d'Honneur en or de 2e classe ;
3° Médaille d'Honneur en argent de 1re classe ;
4° Médaille d'Honneur en argent de 2e classe.

Art. 3. — Nul ne peut obtenir la médaille d'Honneur en argent de 2e classe s'il n'a au moins 15 ans de services ou de pratique professionnelle. Toutefois, en ce qui concerne les militaires indigènes, le temps de service exigé pour l'obtention de cette distinction est ramené à 12 ans.
Les médailles de chacune des catégories supérieures ne pourront être attribuées qu'à ceux qui sont titulaires depuis cinq ans au moins, de la médaille du degré immédiatement inférieur.

Art. 4. — La médaille d'Honneur est attribuée sans condition de durée de service aux indigènes qui se sont signalés par actes particulièrement méritoires de courage et de dévouement.
Les titulaires de la médaille d'Honneur décernée, pour action d'éclat accomplie au péril de leur vie pourront recevoir une allocation de 12 piastres par an, imputable sur les fonds du budget général. Cette allocation sera accordée par arrêté du Gouverneur général, pris en Commission permanente du Conseil de Gouvernement, sur rapport motivé de l'autorité compétente.

Art. 5. — La médaille d'Honneur est décernée par le Gouverneur général :
1° Sur la proposition des Chefs d'Administration locale, des Chefs des Services généraux ou des Chefs des Services du Gouvernement général, pour les candidats civils ;
2° Sur la proposition du Général Commandant supérieur des troupes du groupe de l'Indochine, quand il s'agit des militaires indigènes.

Art. 6. — La médaille est du modèle de 27 m/m. Elle porte d'un côté l'effigie de la République française entourée des mots « République Française » et sur l'autre face, en exergue, l'inscription « Indochine Française » avec, au milieu d'un cartouche, le nom et le prénom du titulaire.
La médaille est suspendue à un ruban tricolore disposé verticalement, par une bélière.
La bélière des médailles d'Honneur en or et en argent de 1re classe est en vermeil. Celle des médailles d'Honneur en or et argent de 2e classe, est en argent.

 Art. 7. — La médaille et le brevet sont remis gratuitement aux titulaires.
Les frais d'insigne et de brevet sont à la charge du budget général.

Art. 8. — En cas de faute grave, l'autorisation du port de la médaille peut être suspendue ou retirée par décision du Gouverneur  général.

Art. 9. — Sont abrogées toutes les dispositions des arrêtés antérieurs contraires au présent arrêté.

Art. 10. — Le Directeur du Cabinet du Gouverneur général est chargé de l'exécution du présent arrêté.

In view of the decrees of October 20th, 1911, on the fixation of the powers of the Governor General and financial and administrative organization of Indochina;
In view of the decree of July 2nd, 1935;
In view of the decree of April 28, 1869, fixing the remuneration given to the decorated natives and those holders of medals in gold and silver;
In view of the order of January 22nd, 1902, determining the purely honorific character of the Medal of Honour,

      ORDERS :

First article. — There is established in Indochina a Medal of Honor to reward services rendered by individuals, civil servants and native agents in the public services of the Colony, and the Indochinese military.

Article 2 — The Medal of Honor consists of 4 grades :

1st - Medal of Honor in gold 1st class ;
2nd - Medal of Honor in gold 2nd class ;
3rd - Medal of Honor in silver 1st class ;
4th - Medal of Honor in silver 2nd class.

Article 3 — No one can obtain the Medal of Honour in silver in 2nd class if they do not have at least 15 years of service or professional practice. However, with regard to the native military, the service time required to obtain this distinction is reduced to 12 years. The medals for each grade above will only be awarded to those who hold at least five years the medal of the next lower grade.

Article 4 — The Medal of Honor is awarded irrespective of length of service to natives who have distinguished themselves particularly by meritorious acts of courage and devotion. The holders of the medal of honor for remarkable feats fulfilled at peril to their lives will be able to receive an allocation of 12 piastres per year, attributable from the funds of the general budget. This allowance will be granted by order of the Governor General, taken in the Permanent Commission of the Council of Government, on reasonable report of the competent authority.

Article 5 — The Medal of Honour is awarded by the Governor General :
(1) On the proposal of Heads of Local Government, Heads of Corporate Services or Heads of Government General Services, for civilian candidates ;
(2) On the proposal of the General Commandant Superior of the troops of the Indochina Group, when it comes to native military.

Article 6 — The medal size is 27 mm. It bears on one side the effigy of the French Republic surrounded by the words "French Republic" and on the other side, highlighted the inscription "French Indochina" with in the middle a cartouche, the surname and name of the holder. The medal is suspended from a tricolor ribbon positioned vertically, by a suspension brace. The suspension of the Medals of Honor in gold and silver in 1st class is in gold plate. For the Medals of Honor in silver and gold in 2nd class, it is in silver.

Article 7 — The medal and the certificate are provided free of charge to the recipients. The badge and certificate costs will be borne by the general budget.

Article 8 — In the event of serious misconduct, the permission to wear the medal may be suspended or withdrawn by decision of the Governor General.

Article 9 — This repeals any previous order provisions which may be contrary to this present order.

Article 10 — The Director of the Cabinet of the Governor General is responsible for the implementation of this Order.
