THE MEDALS OF FRENCH INDOCHINA

ARRÊTE instituant en Indo-Chine un Ordre du Mérite, destiné à récompenser les services rendus à l'agriculture, au commerce, à  l'industrie et aux arts par les indigènes et les Asiatiques étrangers.

Le Gouverneur général de l'Indo-Chine,

 Vu le décret du 21 avril 1891;
 Sur le rapport du Directeur des Affaires civiles;
 La commission permanente du Conseil supérieur de l'Indo-Chine entendue,

  ARRÊTE :       

 Article premier. — Il est institué en Indo-Chine un Ordre du Mérite, destiné à récompenser les services rendus à l'agriculture, au commerce, à l'industrie et aux arts par les indigènes et les Asiatiques étrangers.

 Art. 2. — L'Ordre du Mérite comprend trois classes, auxquelles sont attribuées :
 La 1re classe, une croix en or;
 La 2e classe, une croix en argent ;
 La 3e classe, une croix en bronze.

 Art. 3. — Le nombre maximum des titulaires des croix du Mérite résidant en Indo-Chine est ainsi fixé :
 1re Classe, 10 titulaires;
 2e Classe, 100 titulaires;
 3e Classe, 500 titulaires.
 Tant que les cadres seront incomplets, le nombre des nominations qui pourront être faites dans le cours d'une année ne pourra excéder 200.
 Lorsque les cadres seront au complet, le nombre annuel des nominations sera, au plus, égal à celui des extinctions.

 Art. 4. — Les nominations dans l'Ordre du Mérite sont faites par le Gouverneur général, sur la proposition des chefs des administrations locales ou des directeurs et chefs des services généraux, après avis du Conseil de l'Ordre, la commission permanente du Conseil supérieur de l'Indo-Chine entendue.
 Elles ont lieu une fois par an, au 1er  janvier, sauf les circonstances exceptionnelles qui pourraient nécessiter des nominations isolées.

 Art. 5. — Le Conseil de l'Ordre du Mérite est composé, sous la présidence du Directeur des Affaires civiles de l'Indo-Chine, de quatre membres, nommés chaque année par arrêté du Gouverneur général, dont deux au moins seront titulaires de la croix du Mérite de 1re Classe.
 Le Conseil de l'Ordre est appelé à donner son avis sur toute proposition de nomination ou de radiation des cadres, ainsi que sur tout projet de modification aux présents statuts de l'Ordre.

 Art. 6. — La croix du Mérite est accordée  aux indigènes et aux Asiatiques étrangers dans les conditions suivantes :
 Aux agriculteurs qui ont fait faire des progrès à la culture ou à l'élevage, qui ont mis en valeur des terres en friche, creusé des canaux, drainé ou irrigué le sol;
 Aux commerçants qui ont contribué au développement du commerce par l'établissement de nouvelles relations commerciales ou de services de navigation;  par la fondation ou l'extension de maisons de commerce ou de succursales;
 Aux industriels qui ont créé ou importé une industrie ou développé une industrie existante;
 Aux artistes et artisans qui ont créé perfectionné ou importé un art, ou qui se sont montrés particulièrement habiles dans l'exercice d'un métier de caractère artistique;
 Aux personnes qui ont libéralement exécuté des œuvrées d'intérêt public ou fondé des institutions de bienfaisance.

 Art. 7. — Sauf le cas de services exceptionnels ou de nouveaux services visés dans l'arrêté de nomination, nul ne pourra être nommé dans l'Ordre du Mérite qu'à la 3e classe ou promu d'une classe à la classe supérieure qu'après cinq années.

 Art. 8. — Les titulaires de la croix du Mérite de 1re, 2e et 3e classes auront respectivement rang, dans les cérémonies publiques, de tong-doc phu et huyen. Ils passeront immédiatement après les fonctionnaires en exercice possédant ces grades ou les grades équivalents.

 Art. 9. — La croix du Mérite se porte sur la poitrine, à gauche, suspendue à un ruban jaune.
 La croix et le brevet sont remis gratuitement aux titulaires.

 Art. 10. —  Dispositions transitoires. — Par dérogation aux dispositions des articles 4 et 5 qui précèdent, les premières nominations dans l'Ordre du Mérite seront faites sur la proposition des chefs des administrations locales et des services généraux, après avis du Directeur des Affaires civiles, la commission permanente du Conseil supérieur de l'Indo-Chine entendue.
 Le Conseil de l'Ordre sera nommé dès que l'Ordre comprendra deux membres titulaires de la croix de 1re classe.

 Art. 11. — Le Directeur des Affaires civiles et le Directeur de l'agriculture et du commerce de l'Indo-Chine sont chargés, chacun en ce qui le concerne, de l'exécution du présent arrêté.

ORDER establishing in Indochina an Order of Merit, to reward services given in agriculture, trade,  industry and the arts by natives and Asian foreigners.

The Governer General of Indochina,

 In view of the decree of 21st April 1891;
 On the report of the Director of Civil Affairs;
 The Permanent Commission of the Senior Council of Indochina in agreement,

  ORDER :

 First article.  — There is established in Indochina an Order of Merit, to reward service given in agriculture, trade, industry and the arts by natives and foreign Asians.

 Article  2. — The Order of Merit consists of three classes, to which are awarded :
 The 1st class, a cross of gold ;
 The 2nd class, a cross in silver ;
 The 3rd class, a cross in bronze.

 Article  3. — The maximum number of holders of the Cross of Merit residing in Indochina is thus fixed:
 1st Class, 10 holders;
 2nd Class, 100 holders;
 3rd Class, 500 holders.
 While the rolls are incomplete, the number of nominations which can be made in the course of a year may not exceed 200.
 Once the rolls are filled, the annual number of nominations will be, at most, equal to that of the number of deceased.

 Article  4. — Nominations in the Order of Merit are made by the Governor General, on the recommendation of the heads of local administrations or of the directors and heads of general services, after approval by the Council of the Order, and agreement of the Permanent Commission of the Senior Council of Indochina.
 They are held once a year, on January  1st, unless in exceptional circumstances which might require isolated nominations.

 Article  5. — The Council of the Order of Merit is composed, under the chairmanship of the Director of Civil Affairs of Indochina, of four members, appointed each year by order of the Governor General, of which at least two will be holders of the Cross of Merit, 1st class.
 The Council of the Order is called to give its opinion on any recommendation of nomination or expulsion of members, as well as on any proposed amendment to the present statutes of the Order.

 Article  6. — The Cross of Merit is given to  the natives and to the Asian foreigners under the following conditions:
 To farmers who have made progress in cultivation or animal husbandry, who have developed fallow land, dug canals, drained or irrigated the earth;
 To merchants who have contributed to the development of trade through the establishment of new trade relations or navigation services; by the founding or the expansion of commercial firms or branches;
 To manufacturers who have created or imported an industry or developed an existing industry.
  To artists and artisans who have created, perfected or imported an art, or who have shown themselves to be particularly adept in the practice of an artistic trade;
 To those who generously carried out work of public interest or who founded charitable institutions.

 Article  7.  — Except in the case of exceptional service or new services referred to in the order of nomination, no person shall be appointed to the Order of Merit except to the third class, or shall be promoted from one grade to the next grade until after five years.

 Article  8. — The holders of the Cross of Merit of 1st, 2nd and 3rd classes will have rank respectively, in public ceremonies, of tong-doc, phu and huyen.  They will follow immediately after the serving civil servants holding these or equivalent ranks.

 Article  9. — The Cross of Merit is worn on the left breast, suspended from a yellow ribbon.
 The cross and the certificate are given free of charge to holders.

 Article  10. —  Transitional arrangements. — As an exception to the provisions of articles 4 and 5 above, the first appointments to the Order of Merit will be made on the recommendation of the heads of local administrations and general services, with the opinion of the Director of Civil Affairs, and with the agreement of the Permanent Commission of the Council Superior of Indochina.  
 The Council of the Order will be named as soon as the Order includes two holders of the cross of the 1st class.

 Article  11. — The Director of Civil Affairs and the Director of Agriculture and Trade of Indochina are responsible, in so far as each is concerned, with the fulfillment of this decree.

            Given the ministerial order of April 30, 1900, an Order of Merit is established in Indochina destined to reward the services rendered to agriculture, commerce, industry and the arts by natives and foreign Asians. It was modified by the ministerial order of February 15, 1919;
            Given the transcript of the session of September 18, 1919, performed by the Council of the Order of Merit established by the ministerial order of September 11, 1919;
            The Permanent Commission of the Government Council of Indochina,

                        MINISTERIAL ORDER:

Article 1. - The number of holders of the 1st class cross of merit is increased from 10 to 15, as stipulated by article 3 of the aforementioned ministerial order of April 30, 1900.

Art. 2. - The Director of the Cabinet is in charge of the execution of this ministerial order.

            Art. 2. - Le Secrétaire général du Gouvernement général de l’Indochine, les Chefs d’Administration locale y compris l’Administrateur en chef du territoire de Kouang-tchéou-wan, le Directeur des Services économiques et le Directeur des Affaires politiques sont chargés, chacun en ce qui le concerne, de l’exécution du présent arrêté.

They will be held once a year, with the arrival of every new year, except for extraordinary circumstances which may call for isolated nominations.

            Art. 2. - The Secretary General of the General Government of Indochina, the Chiefs of Local Administration, included the Administrator in Chief of the Kouang-tchéou-wan territory, the Director of Economic Services and the Director of Political Affairs are in charge, each as far as it is concerned, of the execution of this order.
